MediaCrossing Privacy Policy

MediaCrossing Inc. (“MediaCrossing”) has adopted these privacy principles for our Services (as defined below) and for our corporate website located at www.mediacrossing.com (“MediaCrossing Website”). This Privacy Policy also provides information about advertising activities we undertake across internet websites on behalf of MediaCrossing clients. This Privacy Policy does not apply to any other services or websites.

MediaCrossing adheres to the Self-Regulatory Program for Online Behavioral Advertising set forth by the Digital Advertising Alliance, including serving the Advertising Option icon (Ad Choices). MediaCrossing provides various services for its clients such as media planning and buying, marketing communications planning, and campaign analytics (“Services”).

The sections below describe how user information is collected in connection with our Services, including delivering advertisements that may appear on various websites (which includes Apps and other online services). We may also utilize the Services on the MediaCrossing Website.”

The categories of information we may collect include:

  • Device Information, which includes cookies or other similar identifiers
  • Contact Information, which includes address, email address and telephone numbers

INFORMATION COLLECTED THROUGH OUR SERVICES

Contact Information Collected by our Services

We do not intentionally collect personally identifiable information (“Contact Information”) from users online through advertisements we manage on behalf of our clients. Contact Information generally refers to identifying information such as an individual’s name, mailing address, phone number or e-mail address

Device Information Collected by our Services

The third party service providers that we engage to deliver advertisements to you on behalf of our clients through other websites and collect data on the MediaCrossing Website for similar purposes (our “Ad Providers”) do collect non-personally identifiable information (“Device Information”) to identify the devices you use (such as different computers, mobile devices and the browsers and Apps on such devices) and non-personal information about you such as your interests and demographics. Device Information is not intended to identify you personally by name, email address or similar information. Ad Providers may collect Device Information regarding your web browsing, usage or interactions with advertisements we manage on behalf of our clients. We do this to better customize the sort of advertisements you see on various websites and for other purposes such as research and analysis. Device Information may include information such as the type of Internet browser used by an online user, the type of device operating system used, the device’s Internet protocol (“IP”) address, the domain name of the websites visited before and after viewing an advertisement, as well as information related to websites and web pages a user is viewing when an advertisement is shown. In the context of Device Information, whenever we refer to ‘you’ or ‘yours,’ please remember that we may be referring to a device and not an identifiable person since we generally do not know who is using a device at any particular time.

Through the collection and use of Device Information, we offer a range of Services to allow advertisers and MediaCrossing to show you the most useful and relevant online advertisements across numerous websites and to prevent excessive or repeated deliveries of the same advertisements. For example, if our analysis leads us to believe that a user is interested in surfing, then our Services may help our clients deliver interest-based online advertisements to you regarding surf boards. Ad Providers collect Device Information through the use of cookies, pixels and related technologies managed by our partners and vendors. A cookie is a file on your browser that uniquely identifies your browser and device. A pixel is a line of code which is used by a website or third party to assign online activities to a device or browser. The use of a pixel allows Ad Providers to record, for example, that a user has visited a particular web page Though Device Information does not personally identify anyone, we are still committed to giving users the opportunity to exercise choice about the Device Information we collect. See the section titled User Choice & Opt-Out to learn about how you can exercise control over the collection of such data.

Disclosure of Information to Third Parties

We do not collect Contact Information via advertisements that we deliver without your consent. However, if you affirmatively and deliberately provide Contact Information via one of the advertisements delivered to you, then that Contact Information will be provided to the advertiser, and such Contact Information shall be subject to that advertiser’s privacy policy. Device Information collected through our Services, and information derived from it, may be disclosed to our clients and vendors.

We may disclose a user’s information to third parties when we reasonably believe we are obligated to do so by law, and in order to investigate, prevent, or take action regarding suspected or actual prohibited activities, including, but not limited to, fraud and situations involving potential threats to the physical safety of any person. In addition, we may also disclose and provide access to a user’s information to our vendors and contractors who are performing services on our behalf. However, such vendors and contractors are not permitted to use such user information for any purpose other than providing services to us.

User Choice & Opt-out

You have options over how your Device Information is collected and used for advertising purposes.  We comply with the Self-Regulatory Program for Online Behavioral Advertising set forth by the Digital Advertising Alliance.

To opt-out of interest-based advertising as provided by MediaCrossing or Ad Providers, visit http://optout.aboutads.info/.

You may also opt out of certain ads provided in Apps using the “AppChoices” mobile application, which you can download to your mobile device from your App Store.

If you do opt-out, you may still receive advertisements provided by MediaCrossing and Ad Providers, but they will not be interest-based ads delivered to you based on your past behavior across the Internet.

Whether or not you opt-out of interest-based advertising, MediaCrossing and Ad Providers may use various technologies in order to place cookies on your device when you view an advertisement for purposes such as measuring the number of ads delivered or their effectiveness.

You may adjust your device’s web browser settings to refuse all cookies. However, by doing so, you may not be able to use certain features on the websites you visit or take full advantage of all the website offerings and interest-based advertising. You can remove cookies by following directions provided in your Internet browser’s “help” file.

Cookie-based opt-outs are not effective on mobile applications. Users may opt out of certain advertisements on mobile applications or reset advertising identifiers via their device settings. For iOS devices, you may opt out of such collection by turning on the “Limit Ad Tracking” flag in the Advertising subsection of the Privacy section of your Settings. For Android devices, select the “Opt-out of Interest-Based Ads” or “Opt out of Ads Personalization” in the Ads section of the Google Settings App.

If you buy a new device, upgrade or change web browsers or take any action which results in the deletion of this “opt out” cookie, you will need to perform this opt-out process again. In order for the opt-out to work, your browser must be set to accept third party cookies. Opting out does not necessarily delete or replace all cookies from our domain.

We do not respond to or honor “do not track” (a/k/a DNT) signals or similar mechanisms transmitted by web browsers.

ADDITIONAL INFORMATION WE COLLECT THROUGH THE MEDIACROSSING WEBSITE

If you provide us information through our “contact us” link on this website, submit information in connection with an employment inquiry or otherwise submit information to us, we will keep a record of the information you provide including your email address and any other Contact Information you provide solely for the purpose of responding to your inquiry or to provide you with requested marketing materials or newsletters. Except as set forth in this Privacy Policy, this information will never be shared with third parties without your consent.

Opt-out from MediaCrossing Marketing

MediaCrossing may use cookies and similar technologies on this website to collect Device Information to be used for our own advertising purposes, such as serving you an advertisement about MediaCrossing when you visit other websites.  In such instances, these activities on behalf of ourselves operate much the same as the Services we provide to our clients.  Again, you may exercise control over how such information is collected and used through the instructions provided above in the User Choice & Opt-out section

Be sure to include your name, username and clear instructions regarding any change to your Contact Information including email address or if you would like us to unsubscribe you from our database.

GENERAL POLICIES FOR OUR SERVICE AND OUR WEBSITE

Data Retention

We may use our anonymous cookie information for advertising purposes for up to 24 months. After such 24 month period, we delete the anonymous cookie information in its raw data form, while we may retain aggregate reports generated from this information for longer periods of time for reporting purposes.

Information Security

We follow generally accepted industry standards to protect against the unauthorized access to, retention of, and disclosure of information. This includes undertaking necessary physical, electronic, and management activities required to protect information integrity, access, and use. Any information that is stored on our server is treated as confidential information. Please keep in mind, however, that despite these reasonable efforts to protect information on our servers, no method of transmission over the Internet is guaranteed to be secure. Therefore, while we strive to protect your information at all times, we cannot guarantee its absolute security.

Change to this Privacy Policy

Please note that because of the changing nature of privacy laws, user needs, and our business, we may modify this Privacy Policy from time to time by posting a revised Privacy Policy to our website.  If we plan to materially change how we use previously collected Contact Information, we will provide you with advance notice and an opportunity to opt-out of such new uses before implementing such modifications. Accordingly, since we want to help you clearly understand our Privacy Policy, and any pertinent revisions, we encourage you to review our Privacy Policy periodically to become aware of any changes that may have occurred.

Children’s Privacy

We have no intention of collecting personal information from children under the age of 13. Our Services and our website are not directed to children under 13.  When we become aware that personal information from a child under 13 has been collected without such child’s parent or guardian’s consent, we will use all reasonable efforts to delete such information from our database.  If you believe your child has provided us with personal information, and you would like to have the information removed, please contact us at privacy@MediaCrossing.com.

Linking to Other Websites

A link from our own website to another website does not imply our endorsement of that website. We do not control the websites to which we link and assume no responsibility for their content or privacy policies. Therefore, you should carefully review the privacy policies that apply to any websites you access from our website.

Social Media

Our website contains links and interactive features with various social media platforms.  If you already use these platforms, their cookies may be set on your device when using our website. You should be aware that personal information which you voluntarily include and transmit online in a publicly accessible blog, chat room, social media platform or otherwise online may be viewed and used by others without any restrictions.  We are unable to control such uses of your information when interacting with a social media platform, and by using such services you assume the risk that the personal information provided by you may be viewed and used by third parties for any number of purposes.  While we do not provide third parties with the identity of our visitors, if you have a previous relationship with a third party, such as a social media provider, which allows them to recognize you through identifying tools including cookies, that party may collect such identifying information while you are on this website.

Rights to Your Information

Right to Know About Personal Information Collected or Disclosed

As a California Consumer, you have the right to request that we disclose certain information to you about our collection, use or disclosure of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access and Deletion Rights), and subject to certain limitations that we describe below, we will disclose such information. You have the right to request any or all of the following:

  • The categories of personal information we collected about you.
  • The categories of sources from which the personal information is collected.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. However, we may retain personal information that has been de-identified or aggregated. Furthermore, we may deny your deletion request if retaining the information is necessary for us or our service provider(s) in order to perform certain actions set forth under CCPA, such as detecting security incidents and protecting against fraudulent or illegal activity.

Only you, or a person or business entity registered with the California Secretary of State that you authorize to act on your behalf (an “authorized agent”), may make the requests set forth above.

The request should include your contact information and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. In addition, you should provide sufficient information that allows us to reasonably verify that you are the person about whom we collected the personal information or an authorized representative of that person.

Non-Discrimination – We will not discriminate against you for exercising any of your CCPA rights.

EU data subject rights

If you are a situated in the EU, under the General Data Protection Regulation (“GDPR”), as a data subject, you have the following rights:

  • Right to access – This right allows individuals to obtain confirmation as to whether or not Personal Information concerning him or her is being process and provide access to such Personal Information. It also allows individuals to request details of the processing of his or her Personal Information, including, without limitation, categories of recipients to whom the Personal Information have been or will be disclosed and purposes of processing.
  • Right to rectify – This right allows individuals to rectify any inaccurate Personal Information about him or her.
  • Right to restrict processing – This right allows individuals to block or suppress processing of Personal Information under certain circumstances.
  • Right to be forgotten – This right is also known as the “right to erasure”. It is an individual’s right to have Personal Information erased or to prevent processing in specific circumstances.
  • Right of data portability – This right allows individuals to move, copy or transfer Personal Information from one place to another in a secure manner without interrupting the integrity and usability of the information.
  • Right to object to processing – This right allows individuals to object to certain types of processing, including direct marketing, profiling and providing for purposes of scientific or historical research and statistics.

Additionally, if we rely on consent for the processing of your Personal Information, you have the right to withdraw it at any time and free of charge. When you do so, this will not affect the lawfulness of the processing before your consent withdrawal.

Please note that in order for you to assert these rights, we may need to verify your identity to confirm your right to access your Personal Information.  This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. In order to verify your identity, we may need to gather more Personal Information from you than we currently have.

 Data Storage – United States

Our website and databases are maintained in the United States of America. By using the website or our Services, you freely and specifically give us your consent to collect and store, your information in the United States and to use your information as specified within this Privacy Policy.  We transfer Personal Information from the EU to the USA and other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. Information stored in the USA may be subject to lawful requests by the courts or law enforcement authorities in the USA.  Personal Information of data subjects within the EU will be transferred in compliance with the requirements of the GDPR.
